Discord surrounding abortion aren’t uncommon. Such a sensitive matter the coming of a child is! But this incident has highlighted more than other such cases do. It had proved that a certain extent of legislation and battle over fetal rights (abortion rights) can be obstructive to a healthy resolution. Abortion Rights: Teenage Father Sues A Clinic for Terminating Girlfriend’s Pregnancy Without His ConsentA teenage girl in Alabama, USA found she was six weeks pregnant and didn’t want to keep the child. Opposing her then Boyfriend’s consent she took to a clinic and medically got rid of the fetus. Ryan Magers, the teenage then ‘would be’ father to the unborn child went on to sue the clinic and the pill manufacturer for terminating the pregnancy of his then-girlfriend. But the core of this case lies in the fact, the Alabama attorney recognized the unborn fetus as a person with rights and the court allowed Ryan to sue the clinic- Alabama Women’s Center for Reproductive Alternatives (where his girlfriend got rid of the pregnancy) on behalf of the fetus. The Mirror reported such a case was the first of its kind in the state according to Ryan’s lawyer. One of the most perplexing facts about this case is that the Madison County allowed teenage father Ryan Magers to sue the clinic on behalf of the fetus as well. Madison County Probate Judge- Frank Barger issued a Decree that explicitly stated the suing fetus as “Baby Roe” and allowed plaintiff Ryan Magers to name the unborn child as co-plaintiff in a suit for “wrongful-death,” according to the Washington Post. Magers, in the first place, was able to file a case because of Alabama’s “personhood” law that empowers fetuses with a full set of laws. The incident took place in February 2017 when Magers was 19 years old and his then-girlfriend- 16. Magers was unemployed, and this alarmed the pro-choice activists, reported the Mirror. A Battle that could never Win for any BetterThe incident happened two years ago, but according to Lad bible, Ryan Magers is still fighting on the case because he believes that men should have the right to choose over their unborn baby (if or not baby should be kept) even if the partner doesn’t. “I’m here for the men who actually want to have their baby,” told Ryan Magers to WAAY 31. He went on to say that his whole world as if fell off after knowing his baby won’t survive. He said he believes every baby has the rights to live since it was conceived. And now when there is no way the baby could be returned, he said he is fighting to give voice to future would-be dads who’d find themselves in the same spot as himself. Ryan told- “I just tried to plead with her and plead with her and just talk to her about it and see what I could do, but in the end, there was nothing I could do to change her mind. Even though there’s nothing I can do for the situation I was in, there is something I can do for the future situations for other people,” reported Lad bible. He even mentioned how he tried to change the mind of his’ partner but in vain- “I just tried to plead with her and plead with her and just talk to her about it and see what I could do, but in the end, there was nothing I could do to change her mind.” Lawsuits on abortion rights over unborn babies have never had settling tendency in the US. This case, involving an unborn fetus fighting for its ‘would-have-lived’ rights is first-time in the state. Such cases hint to a blurred future on women and her rights over an unborn child that is still lathed to her body.
